      I am now in Delaware Superior Court, appealing the $2000 judgement against me, from the injuries sustained, when my Hund was straight-up attacked by a Jack Russell Terrier, and my dog was only defending himself, with a JRT hanging from his neck.

      I recently found out, that Chris Russell, the dude, that forgot about the repeated warnings, about NOT getting near my dog, actually lied to me.

      Chris told me, that the hospital would contact the SPCA, to make sure my dog had all his shots.
      This is partially true, and my dogs are always up on their shots, and the SPCA had no issue with the 12-14 stitches, and the torn $300 jeans, that Mr. Russell endured.

      Sgt. Barnes of the Kent County told me, that Chris Russell called in a complaint against my dog, a day before the hospital contacted them, for the mandatory follow up.

      This is now being brought up by Santiago, saying that my dog has a proven aggressive record.

      Sgt. Barnes confirmed, that that is just not true, I have never had any SPCA complaints.

      Great to hear! Not surprising that the owner tried pulling that card on you. Sounds like a couple other small dog owners I've known.

      I'm so tired of small dogs snapping at my sweet and submissive golden retriever. The owners never say anything to their dog to correct it.

      My mellow boy just keeps on wagging his tail while rolling over on his back as usual.

      I just now, saw the replies...

      Off my property, Hund is totally calm, walking him without a leash, he ignores people after a quick look, and other dogs, unless they're meeting.

      I prefer large dogs, but Hund doesn't care, he likes almost all dogs...

      Funny thing happened when Santiago tried to question my witness:
      Santiago: Have you had any problems walking your dog past my house?

      Dennis: My wife walks the dog...

      Santiago: Has your wife had any issues with my dog, running around loose?

      The judge allowed this line of questioning, but it sounds like hearsay to me.

      Dennis replied: Yes, and it got so bad, that she finally stopped walking the dog.

      That was the main thing, that won the case...

      Also, the jury didn't believe his claim, that I led my dog onto his property, so that Hund could attack the Jack Russell.

      He also admitted that his JRT ran up to my dog, but tried to claim, that his dog stopped at the property line.

      Btw, I'm still waiting on Judge Cooch to mail me the final judgement, and to find out if I get my $620 in court costs returned to me.
      Delaware Superior Court has 90 days to complete the final judgement, or whatever it's called.
      The jury was out for 10 minutes, but I'll probably have to wait the full 90 days...

      I finally got the court decision... It took almost 3 months.



      The full decision is on my Facebook page.

      I was denied my $620 court costs, because Judge Cooch didn't think it was necessary for me to have a jury trial, his decision proves, that really needed that jury.

      $1382 savings...

      I'm thinking of taking him to small claims court, in Middletown, not Wilmington where he works, and this time, I'll request a jury trial, and subpoena the SPCA sergeant...

      I think it's only $30...

      If I lose, my savings goes down to $1352, and if I win, I'll get my $620 back, $1972, after deducting the $30 court cost.

      You actually helped jar my memory...

      Pretty sure he targeted me after looking up my driving record, and thing I would be an easy target, and contacted SPCA 10 days later.

      What this wad didn't realize is that I like most dogs over most people, and I completely blame the dog's behavior on the owner.

      I finally called the SPCA, about the aggressive Pug down the street, after the Pug tried 3 multiple strikes at Hund's face.

      Get this, that call was brought up April 25th, when he mentioned the number of calls to my house.

      Well let's see, there was the sex offender from Sussex Underground via a 2 black Rabbit GTI sale:

      The pedestrian that fell, and scraped himself on the asphalt, after Hund ran out to him, and circled him twice. I offered 1st aid, which he turned down, and then several months later, tries to say that Hund bit him.
      1) If Hund bit him, he would not have turned 1st aid.
      2) If Hund bit him, he would have asked for proof, that the dog is up on his shots.
      3) If Hund bit him, it wouldn't have looked like 10-15 tiny scrapes, like a rough concrete, or asphalt slide.

      He only lied about being bit by Hund to help his neighbor, Santiago with the Jack Russell Terrier, and did all the re-modelling on Santiago's house.
