QUEEN CREEK, Ariz. - Authorities in Pinal County say a driver who was texting on his cell phone was injured Tuesday when he failed to see a train at a rail crossing until it was too late.
Pinal County Sheriff's spokesman Tim Gaffney says 30-year-old Jason Michael Hair was driving his car westbound on Arizona Farms Road near Queen Creek when the accident happened. A driver Hair passed at about 65 mph told deputies he saw him texting just before the crash.
A Union Pacific freight train was at the grade crossing, the warning lights were on and the crossing arms down. Hair was unable to stop and drove right into the side of the train.
Hair and his 4-year-old son had to be cut from the car's wreckage. Hair had a head injury and his son was flown to the hospital as a precaution.
This happened a few miles from me. This guy have been HEAVILY distracted. You can see that train for miles from either direction; it's a raised rail.
He needs to go to jail, not only for texting while operating a motor vehicle, but more importantly, reckless endangerment, which happened to be his kid.
Cell phones should NOT be present while driving. If it's that important he needs to text, pull over!!!
Granted I do text and drive but only on open highway and stay in the right lane when I check a email quickly or such but serioulsy who doesnt see a train :what:

??? A guy passed @ 65 & the other driver could see all the way across the car that Hair (ha) was texting? The "other driver" has the world's most amazing eyesight... sure, Hair could've been using his mobile, but this is no proof of texting while driving.
It's not hard to tell when a driver is texting. If I can do it while driving a manual, eating a cheeseburger AND loading a shotgun... the average driver, who is admittedly much smarter, and more coordinated than me, should be capable of seeing it too.

After @ 20 seconds perusal of Google Earth, I'm calling BS on the distracted/texting part of the story... the road is dead straight for several miles in each direction, the crossing is above grade with lights & arms, and somehow phone use kept this guy from seeing a train already across the road? Really?? There's more to this story.
I'm going out on a really short limb here by thinking that something else beerwas imparing his driving...
